Yes, Plantagenet, I *know* for what the inmates are supposedly being held, that wasn't the point I was trying to make.

Who has legal standing to declare the charges?
Who has the legal standing to determine/judge the inmates?
Who are the inmates and with what is each actually being charged?

Al Qaida attacked the US on 9/11/01.

US forces subsequently captured some of the Al Qaida leaders who planned and organised the 9/11 attacks.

The US government then charged a group of the detainees as war criminals, and the US is currently trying some of these individuals as war criminals in military tribunals held at Guantanamo Bay. The charges were initially based on criteria for war crimes set up by military lawyers within the defense department. The Supreme Court ruled against the validity of those procedures, so new rules and procedures for war crimes trials were passed into law by the US Congress.

Under the criteria established by Congress, military judges will preside and judge the accused war criminals. The verdicts will be subject to appeal to civilian courts. :)
