What should happen is that when a copright holder sees something on the site that they hold the copyright too they issue a notice and demand it be taken down. If it is the uploader can file a counter note and then the website can restore the video but has to pass on the details of the uploader to the copyright holder and the issue then becomes between those two parties.
Safe harbour means it is not the service providers job to judge wheather something is in violation or not. This is how youtube works. AND this is important for freedom of speech.

Correct. The main objective of SOPA/PIPA is to get rid of the "safe harbor" provisions in the DMCA. When SOPA/PIPA (or whatever incarnation) passes there will be no more "due process", no adversarial system to balance differing interests. You can kiss "fair use" goodbye.
DMCA was becoming too expensive and difficult to enforce in a post peak-oil world. The corporate conglomerates need blunt instruments. It is also meant to shift the burden of self-policing from the content providers to the service providers. In essence, that cost is passed to the consumer and we the people are asked to subsidize for our own prison planet. Also this being a backdoor means for governments to privatize and legitimize censorship, and to get around current privacy laws.
In the end though, I don't think this is just about Hollywood profits, or even government censorship. It is about control on a more pervasive and insidious level. TPTB know TS is about to HTF and TEOTWAWKI is right around the corner. So MU today, TPB tomorrow, but see the forest for the trees and its about much more than just downloading copyrighted material.
