If you had done as you suggested and stayed now, you would have Al Sharpton speaking our against you, picketing by the NAACP outside your home, and a tort lawyer filing a suit against you. Well that complicates matters. If she is legally a woman, then that's that. But what if only her name was changed but she hasn't had surgery yet.. so WHAT IF the girls in the bathroom saw obvious proof she is a man. We also don't really know what happened in that bathroom. This will all have to come out at trial, whether there were mitigating circumstances or if a case for self defense can be made.
However.. no matter what somebody has done, even if it is a man in the womens' room, there's no excuse to beat someone up when they're not fighting back and they're down on the ground. But legally this a bit different from a random attack. The attacker is only 14 years old.. that's very young. We don't know what she saw in that bathroom.. can you really hold a 14 year old to an adult standard of behavior if they come across something as unusual as what they think is a man in the ladies room? Still no excuse, but given the young age here -- 14 -- it's a mitigating factor. Many adult women would never expect to see a man in the womens rest room.
It will be hard to get to the truth on this.. I hate to be blunt, but if the girls saw a penis then that's maybe a mitigating factor for freaking out. The unusual nature of the situation also explains the employees' reluctance to step in.. in their mind this was a man who wouldn't leave the womens' restroom. Complicated situation, all involved are very young.
This will have to go to a jury to get to the bottom of what happened.
By the way.. before they are allowed to get surgery, I think transgendered have to live for a full year as the other gender. And that means using the womens' room. Also I think many don't get surgery for years just because it's so expensive. There was a transgendered woman (bio male) at one company I worked at. To be honest, she was odd.. but harmless. She was treated as female, used the womens' room. The women in the office didn't like it, but he never did anything in there other than use the bathroom. If he had, if there had been one valid complaint, he would have been fired because really the company didn't want this anyway.
These people live very hard lives, they face discrimination and dirty looks literally all day every day. In the case of my coworker she had no friends and her family had disowned her.
So that video makes sense to me, why she didn't fight back.. I can't generalize from just having known one, but the one I knew would act that way too. They're terrified, they're persecuted, they don't look for trouble. But still facts have to come out, we don't really know what happened.
P.S. and I hate to be cynical, but it's also possible this was a lawsuit setup.. we really don't know

Did anyone else notice the sign on the door of the McDonald's in the video? The sign said 'Due to the high number of counterfeit bills this store receives, we no longer accept bills greater than $50.00'.

If its true this person was a transgender then I think they made the right choice in which bathroom to use. I think a transgender would be taking a bigger chance of getting beat up in the mens bathroom. Even if the girls did happen to see his penis which I doubt this person would do that intentionally then there was still no reason to lay a finger on them. If there's a problem and they havent touched or threatened you then you don't have any rights to touch that person. I bet the girls said something mean to the other girl and she made the mistake of saying something back or looking at them wrong. Really it doesnt take much to piss someone like that off.

Strange, I thought the same thing. On duty managers ought to at least have pepper spray. Thing is though, I assume McDonalds policy is same as retail stores, they're not supposed to get involved other than call cops.
What happened here is a good example how that's really not kosher.. you can't have employees watch someone get beat near to death right in front of their eyes, yet do nothing because it's against company policy. Basic humanity has to start trumping corporate policiy.. if somebody is dying at your feet you need to do something.

I think.. I would HAVE to act if somebody were on the floor getting kicked in the head like that. But yeah this is all complicated.. the assailant is 14. If the whole thing weren't filmed and you stepped in, YOU could wind up in jail for being in a fight with a minor. Screwed up world we're in, rules are against anyone acting like a decent human being.
I think the lack of action by most of the employees has a lot more to do with racial affinity than it does with corporate policy. If it was a black girl getting a beat down by two white girls you can be sure there would be swift, decisive actions by the employees in that video. And the NAACP would quickly follow up with mass marches. But violent black-on-white crimes are considered perfectly acceptable by certain folks. Just another day in America. We won't be hearing from the NAACP on this matter.
Re. pepper spray, it's almost totally useless in every way, and stands to cause more harm than good (i.e., accidentally spraying yourself reducing your ability to fight back). A good billy club maybe. A lead pipe would be even better.
As for whether I'd help, (1) I almost never set foot in McDonald's, (2) I avoid areas where hostile racial groups predominate, (3) if I did help, I'd most likely be jumped by the employees. But if I saw this in person, yeah, I'd still probably help. Sucker punching the fat little savages in the back of the head would be a good start, aiming for a knock out. Maybe a quick run out to the truck to get the tire iron I keep in easy reach for just such occasions. And I always keep a good fighting knife on me if things got really out of hand.
