Tanada, the 13th, 14th, and 15th Amendments were civil war amendments passed by the radical republicans to ensure that the rights of newly freed slaves were not repealed by Jim Crow laws. Most realized that slavery was but a name and that the conditions of slavery could be reestablished by state law in the southern states. The 14th Amendment took away the voting rights of those southern white males who had in anyway participated in the rebellion and protected the rights of the freedmen.

The idea was really quite simple. A state under the 14th Amendment was prohibited from violating the rights of a citizen of the United States. Those rights were defined in the Constitution.

The arguments that the Second Amendment only applies to the District of Columbia because it is a federal territory is ludicrous. It would be the same as arguing that freedom of speech is only guaranteed in federal territories.

The collective right argument for the Second Amendment is the argument of gun abolitionist. We should stop using the term gun control. That is a euphemism designed to confuse the simple minded. Those who rally under the banner of gun control are for the most part gun abolitionist. Their agenda is to remove all firearms from the hands of private citizens.

These people are more terrified of an armed citizen than they are of a totalitarian state.

The South West was Mexican territory. Florida was Spanish not Mexican. The rest of the southern states were dominated by white, Anglo-Saxon, Protestants. The southern states that fomented the rebellion had watched their prosperity taxed away by the more populous industrializing north. The abolitionists pushed them over the edge with the election of Lincoln.

Northern workers feared slavery because in theory slaves worked for free and this threatened their jobs. Northern intellectuals objected to slavery on moral grounds. The Mexicans had very little to do with the rebellion.

That's not the argument, though. The argument is that the Federal Gov't can't restrict your rights on guns. It's not that the 2nd Amendment only applies in Federal territories.

This is a very bad interpretation of the situation. Let me help you out since you don't know what you're talking about. A real estate development corporation paid local officials with campaign donations to confiscate a private land owner's property (his private residence) with eminent domain and give the property to the developer. Commercial buildings were then built on the property. That is 100% theft. It has nothing to do with the free market. Nothing at all. You really could not be more wrong.

The whole idea of having to "define" something in law is used to insert ambiguous terms creating loopholes keeps lawyers employed

This is a very bad interpretation of the situation. Let me help you out since you don't know what you're talking about. A real estate development corporation paid local officials with campaign donations to confiscate a private land owner's property (his private residence) with eminent domain and give the property to the developer. Commercial buildings were then built on the property. That is 100% theft. It has nothing to do with the free market. Nothing at all. You really could not be more wrong.

No, it's not. Again, let me give you a correct interpretation of the situation, since your mind-grapes do not have the capacity to see what is going on here. A pig who got to the trough late wants another pig's spot. He pays a bully (the government) to remove the first pig from his trough spot, so the usurping pig can have it.

It's called bribery and theft.

Hey. I'm not the one seeking to reform the free market for the poor, poor small capitalist :( , be they of the colonial or American revolutionary (now there's an oxymoron) cast. :lol:

In fact, I have been consistent in advocating that the free market be left to its own devices to hand the best of what this planet has to offer to the wiliest. .
