I'm a Mexican so it is not about race when I say this woman is a racist of the first order. She supports the socialist programs that gave her personal success and dispises the middle class and white males in particular.

There is no way she will not get the office with the present Senate. More will become enraged with O's changes, 2010 congress changes and his wings are clipped. Make it so. On the other hand, she doesn't change the Supreme Court in any substantial way, a liberal is replaced with a liberal.

Considering we have three white male racists on the Supremes, plus one very confused white racist black guy, some balance clearly is needed. Our country is becoming a place where you don't have to be white and male to get ahead. Deal with it.

So how does that make her any worse than Souter, Kennedy or Ginsburg? From what I can see she doesn't seem qualified, but let's be honest here most of these people are nominated for their perceived adherence to political doctrine rather than their legal foresight. She's a slam dunk the Democrats control the Senate and barring something unusual she's a shoe in.

I really don't like Kennedy and Souter. Kennedy is that little rat bastard who championed the case about 4 years ago where corporations are now allowed to use eminent domain to steal private property from individuals. People who support these sociopaths are blind.

I'm not a lawyer, but I thought that was the general opinion. The US Constitution refers to restrictions and abilities of the Federal Government. Not States, unless otherwise noted (such as the 14th Amendment). In addition to Sonia's 2nd Circuit, the Seventh Circuit, which is filled mostly with Reagan and Bush (both) appointees, recently argued that same point - that states and local governments aren't restricted in the 2nd Amendment.

Reading the text itself, it can swing either way. For me, it would just depend on what "a free State" means. Is state a US state in that sense or does it refer to a nation? Both of which are accepted definitions.

Either the Constitutional document will define the term "State" within the federal context in distinguishing the federal government from state governments (the fact that it distinguishes between the federal government and states as you state above seems to suggest that the term refers to state legislatures) or else the Courts may have arrived at a definition in one or other legal issue within that context and limited that term to the federal government.

A common law definition of a state would, I should imagine, ordinarily contemplate a nation although with the advent of federal style government and the EU, this is likely superceded.

No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
also known as The Equal Protection clause.

The Second Amendment clearly refers to the right of the People to keep and bare Arms, under the 14th Amendment no state "shall abridge the privileges or immunities of Citizens of the United States", therefore no State can restrict your individual Citizen right to keep and Bare arms under the 2nd Amendment of the Constitution unless you have been duly convicted of a crime. However this does not end the debate because jurisdictions smaller than States, that is municipalities and counties, frequently do pass and enforce restrictions.
