My wife works in a law office.

You need to get some kind of handle on how much money the other guy makes and what kind of assets he has, otherwise a civil suit is going to be a waste of your time. Chances are very good that, since he has no insurance, he has no money or assets and you'll will end up getting nothing. The only thing you'll have in the end is a useless paper judgement which can't be collected, and even more debt because of legal fees. There'll be quite a number of lawyers that will be happy to just zip their lips and take your cash, knowing all along you were wasting your time paying them to file a suit that would never go anywhere.

Carrie tells me that guys like this one are labelled "judgement proof" in the business because you can't get blood out of a turnip. Chances are your own insurance company is going to be your only option. If you need to retain a lawyer to sue your own insurance company, usually 33.3% of your settlement is going to be skimmed off the top, even before any of your medical bills get paid. The lawyers make sure they get paid first.

If your health insurance is paying your medical bills right now, be prepared for this shocker: they'll want a piece of your settlement, too, even part of the payout from your own auto insurance, and they will go after it. They expect to be reimbursed in situations like this. This is called "subrogation interest." Nice, eh?

So. Unless you followed the guy home, did some serious research into his financial records, or hired a PI to discover he's got bank in assets, a civil suit is going to get you worse than jack shit--it'll get you farther in debt in legal fees, plus jack shit. I sincerely hope your insurance company is run by nice people.

No, I never drove a Yaris, I drive a ford mustang convertible.

Well, you may want to consider purchasing a Yaris now that you are in need of a car, since Rabbit seems to like his a lot. :lol:
