Copyright Violations & Repetitive Posts

Unread postby MonteQuest » Mon 03 Jan 2005, 01:05:31

Many people are posting entire articles rather than a short quote with a hyperlink. Please don't do this, besides being unneccesary, it often times is in violation of copyright laws. This is usually stated at the bottom of an article like this:

Copyright 2005 The Associated Press. All rights reserved. This material may not be published, broadcast, rewritten, or redistributed.

Secondly, as we grow with new members, I see many repetitive posts on the same subject, especially in the energy forum. Please do a site search to see if a thread you wish to post has not already been discussed. If it has, add to that thread rather than start a new one.

Thanks!

How much of the article can we quote before it is in violation of the rules? Also, what about interviews/articles that have been republished, such as those on the BBC that also appear on the AP wire and Reuters?

And sometimes the link content changes or is no longer there.
I had a habit of doing this on the Fourth Turning Forum, till I learned it was "wrong". Now I just give a comment and the link.

When a work is copyrighted, unless you are the owner or have the specific permission of the owner, you cannot legally make a electronic copy of a complete work. Under the "fair use" rule of copyright law, an author may make limited use of another author's work without asking permission for purposes of commentary and criticism. As a general rule, never quote more than a few paragraphs from a book or article. Besides, with hyperlinks like we support, it is not needed.

When I post a new thread piece like I often do, it is copyrighted when I post it. Technically, if someone here wishes to quote me in it's entirety, they need to ask my permission first. :-D But you all know you have it. So, just use the "fair use" rule with everything, and you will be ok.

Local laws allow me to post up to about 10% of "a work". If a newsprint edition has got 50 articles I am allowed to re-post 5 of them. If it is for educational or research purposes and I'm not trying to make a profit by re-selling the content or something, it's fine.

Some university students took that to extremes and photocopied entire books, there were some warnings and protests etc. but it was no major flap. Actually it's pretty wasteful and unnecessary as well, usually we just need certain chapters, and nobody could stop me from buying Book A, my buddies buying Book B, C and D, and the lot of us swapping them around. You know you can only read one book at a time, right.

I think it'll be a much stronger case if the site owners incorporate PeakOil.Com as a private, non-profit entity. Come on, use the same laws that protect these corporations. PeakOil.Com can then claim to be a living person, operating as a non-profit organization, with the same rights to use portions of work as individual researchers and educators do. Heck, if you do that you can make this place immortal just like the corporations are.

Yup, I've been watching "The Corporation", you could tell

Section 107. Limitations on exclusive rights: Fair use

$this->bbcode_second_pass_quote('US Congress', '
') Notwithstanding the provisions of sections 106 and 106A, the fair
use of a copyrighted work, including such use by reproduction in
copies or phonorecords or by any other means specified by that
section, for purposes such as criticism, comment, news reporting,
teaching (including multiple copies for classroom use),
scholarship, or research, is not an infringement of copyright. In
determining whether the use made of a work in any particular case
is a fair use the factors to be considered shall include -
(1) the purpose and character of the use, including whether
such use is of a commercial nature or is for nonprofit
educational purposes;
(2) the nature of the copyrighted work;
(3) the amount and substantiality of the portion used in
relation to the copyrighted work as a whole; and
(4) the effect of the use upon the potential market for or
value of the copyrighted work.
The fact that a work is unpublished shall not itself bar a finding
of fair use if such finding is made upon consideration of all the
above factors.

basicly, my understanding of "fair use" is that as long as your not MAKING money off it, you can print what you need. (somehow these rights apply only to print, and not Music or Video -the real moneymakers-)

Certainly we all fall under "educational use" here.

That's my story, and I'm sticking with it. :)

This is correct, for US law.

But we want you to include the copyright & a link when possible anyway... it's just polite.
The problem is, of course, that not only is economics bankrupt, but it has always been nothing more than politics in disguise... economics is a form of brain damage.

Killing Fair Use
by Kevin

...
Fair use is the term given to the long established practice of allowing people to quote or show a very small bit of a work without having to get permission or having to pay a usage fee. It is what allows critics and reviewers to demonstrate their points through examples; it allows textbooks to use examples from medical and scientific journals; it allows bloggers to quote part of an article in their own pieces; it allows people to write parodies of songs and written works; it allows teachers to run off photocopies of material to pass out in class. In other words, it is the mechanism by which our culture and economy is enriched.

Without fair use, dissemination of information and discussion of important political, scientific, and artistic concerns becomes much more expensive and much slower, adversely affecting the economy. Teaching and writing textbooks become harder, as does engaging the public in discussions of things copyright holders do not want to discuss. The public will be entirely dependant upon either its ability to pay or the good will of the copyright holders to engage in wide range of activates that we take for granted today and that have driven our cultural and economic engines since the beginning of the Republic.

Otay, A link I've always provided, and I hardly ever pasted full stories (for berevity) , but I guees I try to include a "Copyright" clause in my excerpts...just to be polite.

BP,

Good article. When Mickey mouse can be exteneded in Purpituity, so can the patents on DNA, protections on software, etc etc.

It's back door radical Confucianism with the fudal lords (corpus non vita "Corporations") ruling the pee-on's.

links

Unread postby Cool Hand Linc » Thu 03 Feb 2005, 13:33:09

Another reason to provide a link and tell where information came from is some folks like me will go and read the entire article book etc. Often searching for more works from same.

I never accept at just face value. Quotes can be manipulated. Omitting parts etc can paint a different picture.
Peace out!

If a book is out of print is it then ok to distribute the material within its pages? I have a make-a-mix cook book that gives several homemade master mixes from which you can make a variety of things.

you could buy one of them on amazon for 172.00 canadian but they are out of print haveing been printed in 1978 and the follow up in 1980.

Monte.. I completely agree with the link to an article but most of what is being posted on this site is Meant to be circulated by any means necessary.... most of the articles.... if in fact someone does get prosecuted for copyright infringement on a post on an obscure website I would be glad to see it as it may get some press for our seemingly "not real" situation. (with regard to mainstream media) Also it would serve us well if the mainstream media blasted our site's name all over the 6:00 news and maybe even got us a coveted spot on Insannity & Unknowns on Faux News!!!
