Alaska would join New America, but Hawaii would stay in the Old America. In New America, the constitution would be the supreme law of the land, and all constitutional rights would not be infringed. Of course, we would have to edit the old document some, as to allow regulation of interstate commerce by the federal government would just get New America into the same boat as Old America. The amendments would need to be looked over also, as section three of the fourteenth amendment is not nessecary any longer, federal income tax sucks, and there is no point in having the 18th and 21st amendments staying on board. The text of the Constitution would need to be updated to reflect modern American English also.

The blacked out section of the West Coast could completely throw out the Constitution, and form thier own new socialist regime. The blacked out east states would stay in the Old US where the constitution continues to be neutered. Seems like everyone would be happier with this situation. Lincoln, Nebraska could be our Capital city too!

I dunno, I don't think the US would be particularly open to partition. Washington would not give up its colonies any easier than London gave up its own.

Republicans have trod on the Constitution as much as Democrats. It's the same money backing both, so you can't expect anything else.
